Notes for DELMAR SHECKLER:
Delmar Sheckler, 16, son of Mr. and Mrs. Edward Sheckler, of four miles northwest of this city, was found dead under a clump of poplar bushes in the clearing at the Ernest Stayer woods about a quarter of a mile from the Edward Sheckler home about 10:30 o'clock Friday morning by his uncle Lawrence Egolf, member of a searching party.
The clump of bushes where the body was found was some distance from the highway. Mr. Egolf noticed a pecullar odor tracing it to its source found the body.
The lad lay on his back face up. without a stitch of clothing on him. Coronor O. F. Lehmberg, who was called said that it was difficult to estimate the rapidity with which decomposition had set in, that the lad was dead at least three days and possibly from Sunday night.
The coronor and sheriff J. M. Haynes were loath to give a verdict on the case, and were considering two theories, one that the lad met with foul play, and the other that he committed suicide. More credence was given to the suicide theory, but the local authorities were puzzled by the fact that the lad was naked, that his trousers had one pants leg burned, and that he or someone else, previous to his death, had put his coat, belt, and other articles of clothing in a pile and set fire to them.
The bullet hole was from a rifle bullet, and was in the center of his forehead about an inch and a half from the top of the brow. The rifle was lying at his feet. One shoe was near the body and the other was some distance away.
The rifle was the one the lad took with him and it had been discharged. Coronor Lehmberg made a second trip to the home to make inquiries late Friday afternoon.
The lad was large for his age, weighing around 140 pounds. The family resided in Thorncreek township all thier life, and the lad attended the Foster school. He is survived by the parents, two brothers, Marshall and Max and a sister Ruth, all at home.
Friday morning a searching party started out because as one member of the partyexpressed it, they had a hunch that they might find the body.
Just as the searchers were about to give up the hunt at about 10:30 o'clock, Lawrence Egolf, an uncle of Delmar, noticed a strong odor coming from a clump of poplar bushes some distance from the roadway, and about a quarter of a mile from the Sheckler home, in the Ernest Stayer woods. He went to the clump of bushes where he was greatly shocked to see the naked body of his nephew, with every bit of clothing removed from him. Part of his clothing was hanging on a clump of bushes nearby and his coat lay beside him, partly burned. The body was in such a state, it could not be told whether there were burns on the body.
The lads watch was found near the body, and his gun was lying near his feet. The body was in a bad state of decomposition and the youth had been dead for some time.
A hole that had probably been made by a bullet was found in the lads forehead.
Delmar Sheckler disappeared last Sunday evening after attending the childrens day exercise at the Thorncreek Baptist Church near his home. He took with him his coat and gun. The gun was found beside the body.
Owing to the condition of the body it was buried in the Stough Cemetery Friday afternoon at 5 o'clock. Rev. Al Reider conducted the services.
Funeral services will be conducted Sunday morning at the Thorncreek Baptist Church, Rev. Reider officiating.
RE-OPEN INQUIRY INTO DEATH OF DELMAR SHECKLER
WARRANT CHARGING SHECKLER WITH ALLEGED MURDER OF NEPHEW FILED IN JUSTICE COURT HERE-FATHER OF YOUTH SLAIN IN 1929 ALSO QUESTIONED
The April grand jury will be summoned next Wednesday morning, it was learned here today.
It was intimated here today by authorities that Charles D. Sheckler of Thorncreek Township. re-arrested last night for the alleged murder of his nephew, 16 year old Delmar Sheckler, in July 1929, will be confronted with "strong" evidence.
What this was, the officers declinded to discuss. Sheckler has not been questioned at the jail here since last night when he was arrested northwest of town at the home of his brother, Edward Sheckler.
A new inquiry into what is known as the Delmar Sheckler murder mystery is being conducted by prosecuter Benton E. Gates and Sheriff H. O. Stickler, Whitley county authorities.
As a result of this move, Charles D. Sheckler, uncle of Delmar Sheckler, who was found dead in the Ernest Stayer woods northwest of town on July 19, 1929, faces a new charge of murder.
Justice Joseph R. Harrison stated Saturday morning that there was an affidavit on file in his court in which Sheckler is charged with the murder of Delmar Sheckler.
TAKEN INTO CUSTIODY
Since the time of the alleged murder and before Charles Sheckler had been staying at the home of his brother, Edward Sheckler, father of Delmar Sheckler.
Friday evening at 10 o'clock Sheriff H. O. Stickler and Deputy Sheriff Marion Egolf went to the home of Edward Sheckler, northwest of town and took into custody both Edward Sheckler and Charles Sheckler. No charges of any nature were filed against Edward Sheckler, but he was taken into custody as a material witness. He was in jail Friday night and questioned by officers and released Saturday morning and permitted to return home.
Charles Sheckler was still in the Whitley County Jail Saturday morning. When first arrested last July 26, 1929 and charged with the murder, Sheckler said, "This is a great surprise to me." He seemed more surprised Friday evening than the first time. He did not talk much, but made the comment to officer Egolf that "I will walk," but the latter replied; "You'll ride."
Sheckler was questoned by the officers Friday and Saturday, but at an early hour Saturday morning nothing had developed that cleared up the mystery of the death of Delmar Sheckler.
FOUND IN WOODS
Delmar Sheckler, sixteen year-old son of Mr. and Mrs. Edward Sheckler was found dead, and entirely nude, in the Ernest Stayer woods northwest of Columbia City, a short distance from his home, at 10:30 o'clock Friday morning, July 18, 1929. An uncle, Lawrence Egolf, who was one of a searching party that had hunted for the missing lad for several days, and who were almost ready to give up the hunt, found him. Mr. Egolf was attracted to the spot by an unusual odor and found the naked body.
The lad was lying on his back, with a bullet wound in the center of his forehead. One pant leg of his trousers, his coat, belt, and other clothing was found in a heap, burned, nearly. The rifle was at his feet.
LAST SEEN SUNDAY
He was last seen on Sunday evening, preceding the time he was found, when he left a Thorncreek Baptist Church children's day program, Sunday evening.
BODY EXHUMED
The body was exhumed July 25, 1929, and a postmortem examination held. A large wound in the back, made either by a stick or bullet, was found. Following this verdict of homicide was returned by the coroner.
Sheckler was indicted but the indictment was dismissed and he was released in September 1929.
An attempt to have him proved of unsound mind failed when two Whitley County doctors pronounced him sane.
Sheckler is understood to have asked the court to defend him from the new charge. He also asked the court to appoint an attorney at the time he was first arrested.
Prosecutor B.E. Gates would not say whether or not a new grand jury would be called to investigate the case.
Last Summer scores of automobiles gathered at the scene near the alleged crime owing to a statement of a nearby fortune teller or medium that Delmar Sheckler would arise on the anniversary of his death and name the murderer. He failed to do so.
After Charles Sheckler was convicted and sentenced to prison for life he asked for clemency as he claimed to be innocent. The warden of the Indiana State Prison wrote a letter to Benton Gates asking for advice about the situation. Benton Gates wrote the following letter in response.
W.H.DALY WARDEN STATE PRISON MICHIGAN CITY INDIANA
This man was convicted in the Noble Circuit Court on the charge of murder in the first degree.
Charles D. Sheckler made his home with his brother Ed Sheckler and family in Whitley County, Indiana. Ed Sheckler had a boy by the name of Delmar Sheckler who was just sixteen years old. Charley Sheckler had lost his farm and had lived with his brother for a number of years. He had trouble with his neighbors and his own family. He was considered somewhat of a bully in the community and made numerous threats against different people.
DELMAR
Charley Sheckler and his nephew were unable to get along, and had engaged in a number of squarrels and a number of fistfights. Charley Sheckler had made threats that he would get Delmar Sheckler.
On July 14, 1929, Delmar Sheckler was at church with his family. This churchis situated about three quarters of a mile from the Sheckler home. Charley Sheckler was visiting in a neighbor's house that night and was not at church with the family. Charles Sheckler's own statement was to the effect that he left this neighbor's house about the time church was out, and the neighbor's testimony as well as his wife's testimony substained this.
Charley Sheckler's own statement that he was home about 20 to 25 minues before Ed Sheckler and his family arrived. But he states that he did not see Delmar Sheckler come home. Delmar left the church about ten minutes before his parents and was seen about 300 yards from the house. He did not have a coat on at that time and was not carrying a gun. Five days later his body was found in the woods about half a mile wes of the Sheckler home, nude, the clothes being burned beside his body; body lying flat on his back, one arm back over his head; the other arm across his chest; legs crossed at the ankle with the rifle tucked in under his ankle. He had a stab wound in his back; evidence of a blow on the back of his head, a bullet in the forehead, the course; several teeth knocked out; and scuffmarks all over his body.
The coroner held an inquest, and his verdict was murder. On his affidavit the uncle was arrested and held until September, at which time, the grand jury convened and they failed to indict Charley Sheckler on the charge of murdering his nephew.
A new sheriff took the office the first of the year and reopened the case. The grand jury was called in April and Charles Sheckler was indicted for murder in the first degree of Delmar Sheckler. The evidence in this case was convincing enough that the jury deliberated only about three hours and returned thier verdict of first degree murder and one for second degree murder.
During the year and a half that Charley was out of jail, before he was arrested the second time, he had made a statement to Ed Sheckler that he could not get along with the boy, so he got rid of him, and while he was in jail at Albion awaiting trial i June, he wrote a letter to his brother Ed telling him to keep his mouth shut and not talk too much. He had made numerous statements and admissions, which practically amounted to a confession on his part. These were all proved at the trial. There was no evidence offered by the defendent to contradict any of thee statements or impeach any of the state's witnesses. He took a change of venue out of Whitley County because of neighborhood feeling, and the authorities in Whitley and Noble Counties feel that this man had a just trial and that he was justly convicted of the murderof his nephew, which committed in Whitley County. It would have ben physically impossible for this to be a case of suicide in view of the way the body was lying and all circumstances. The evidence showed him to have had a quarrel with the nephew the night before he was murdered and the mornig before he was murdered.
The evidence showed that the defendent had a motive for murdering this boy and was the only person that it would have been possible to have murdered him in as much as his gun and coat were taken from the house and were with the body at the time it was found, and the uncle's own statement was that he was in the house, and the testimony showed that he knew where his gun and coat were.
This man is of a very peculiar mental makeup, and for years has frightened not only the Sheckler family, but the whole neighborhood in which he resided. His two boys were compelled to run away and leave home because of his abuse, and his daughter was taken from him because he abused her.
People in Whitley County feel that this man should remain in the Indiana State Prison at Michigan City for the rest of his life, and the verdict of guilt and sentence is very popular to the people of the community. This man had a fair trial and not railroaded of misusd in any way. Both the court and the jury felt that there was sufficient evidence of his guilt.
Charles Sheckler died at Michigan City, Indiana while serving his sentence of life imprisonment.
